OVERVIEW

Welcome to The Folk Roaster (“The Folk Roaster”, “we”, “us”, “our”).

These Terms of Service (“Terms”) govern your access to and use of:

  • our website and online store, and

  • any related content, features, tools, products, and services

(collectively, the “Services”).

Our store is powered by Shopify, which provides the e-commerce platform we use to sell our products and run the Services.

By visiting, browsing, or purchasing from our store, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree, you should not use or access the Services.


SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that:

  • you have the consent of a parent or legal guardian to use the Services and to allow any minor dependants to use the Services on devices you own or control.

To place an order or access certain features, you may be asked to provide information such as your:

You are responsible for:

  • colours and appearance may vary depending on your screen, device, and settings;

  • we do not guarantee that your device’s display will accurately reflect product colours or appearance.

  • correct errors;

  • discontinue any product; or

  • limit the quantities of any products offered to any person or region, on a case-by-case basis.

We do not warrant that any product will meet every individual expectation or taste preference.


SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase the products in your cart.

We reserve the right to accept or reject any order at our discretion. Your order is only accepted when:

  • your payment has been successfully processed; and

  • we send you an order confirmation email.

Please review your order carefully before submitting it. After an order is accepted and processing has begun, we may not be able to cancel or modify it.

If we cannot accept, change, or must cancel your order (for example, due to stock issues, suspected fraud, or pricing errors), we will attempt to contact you using the email address and/or billing details you provided at checkout.

All purchases are subject to our Refunds & Returns Policy.

By placing an order, you confirm that your purchase is for personal or household use only and not for resale or export.


SECTION 4 – PRICING, PAYMENTS & BILLING

  • All prices, discounts, and promotions shown in the store are subject to change without notice.

  • The price charged for a product is the price in effect at the time your order is placed and will be listed in your order confirmation email.

  • Unless we state otherwise, prices do not include taxes, shipping, customs duties, or other charges.

We may offer promotions or discounts from time to time. These may have their own terms and conditions. If those conflict with these Terms, the specific promotion terms will apply for that promotion.

By making a purchase, you agree to:

  • provide current, complete, and accurate purchase and account information; and

  • promptly update your details (such as email address, billing details, and payment information) as needed.

You represent and warrant that:

  1. the payment information you provide is true, correct, and complete;

  2. you are authorised to use the chosen payment method;

  3. your payment provider will honour the charges; and

  4. you will pay all charges incurred at the posted prices, including any applicable shipping, handling fees, taxes, and duties.


SECTION 5 – SHIPPING & DELIVERY

We roast and dispatch orders with care, but some parts of the delivery process are outside our control.

  • Any delivery dates or timeframes we provide are estimates only and are not guaranteed.

  • We are not liable for delays caused by shipping carriers, customs, weather, or other events beyond our control.

  • Once we hand your order to the carrier, title and risk of loss pass to you.

SECTION 6 – INTELLECTUAL PROPERTY

All content and materials made available through the Services – including, but not limited to:

  • logos, names, and branding;

  • product photos, images, and graphics;

  • text, copy, and product descriptions;

  • videos and audio; and

  • the design, layout, and overall look and feel of the site

are owned by The Folk Roaster Pty Ltd, our partners, or our licensors and are protected by Australian and international intellectual property laws.

You may use the Services for personal, non-commercial purposes only.

You must not, without our prior written consent:

  • copy, reproduce, distribute, or publicly display any part of the Services;

  • modify, adapt, or create derivative works based on any part of the Services; or

  • use our trademarks, logos, or branding in a way that may cause confusion or imply endorsement.

All trademarks, service marks, and trade names referenced in connection with the Services are the property of their respective owners. No rights are granted to you except as expressly stated in these Terms.


SECTION 7 – OPTIONAL TOOLS & FEATURES

We may provide access to third-party tools, apps, or features (for example, review widgets, quizzes, or subscription apps).

You acknowledge that:

  • such tools are provided “as is” and “as available”;

  • we do not control or monitor those tools; and

  • we make no warranties and assume no responsibility arising from or relating to your use of such tools.

Your use of any third-party tool is entirely at your own risk and discretion and may be subject to that third party’s own terms and policies.

Any new features or tools we add to the Services in the future will also be subject to these Terms, unless stated otherwise.

The Services may contain links to, or content from, third-party websites or services.

We do not control these sites and are not responsible for:

  • their content, accuracy, or policies;

  • any products, services, or materials provided by third parties.

Accessing a third-party site is at your own risk. We are not liable for any loss, damage, or issues arising from:

  • your use of third-party sites; or

  • your purchase or use of any third-party products, services, or content.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products to you.

However, when you purchase from our store:

  • Your sales contract is directly with The Folk Roaster Pty Ltd, not with Shopify.

By using the Services, you acknowledge that Shopify is not responsible for:

  • the sale, fulfilment, or delivery of products; or

  • any injury, damage, or loss related to products or services you purchase from us.

You expressly release Shopify and its affiliates from any claims or liabilities arising from or related to your transactions with The Folk Roaster Pty Ltd.


SECTION 10 – PRIVACY

Your use of the Services is also governed by:

Because our store is hosted by Shopify:

SECTION 11 – FEEDBACK & REVIEWS

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, reviews, photos, testimonials, or other content (“Feedback”) to us, you grant us a:

  • perpetual, worldwide, sublicensable, royalty-free licence

to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any lawful purpose, including for marketing and improving the Services.

By submitting Feedback, you confirm that:

  • you own the Feedback or have the rights necessary to grant the above licence;

  • your Feedback is accurate and not misleading; and

  • your Feedback does not infringe any third party’s intellectual property, privacy, or other rights.

We may (but are not required to) monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, harmful, or in violation of these Terms.

You must not:

  • impersonate another person;

  • submit Feedback that is defamatory, obscene, hateful, or otherwise objectionable; or

  • submit Feedback containing viruses or malicious code.

You are solely responsible for any Feedback you submit and the consequences of posting or sharing it.


SECTION 12 – ERRORS, INACCURACIES & OMISSIONS

From time to time, the Services may contain information that includes typographical errors, inaccuracies, or omissions. This may relate to:

  • promotions and offers;

  • shipping charges;

  • delivery times; or

  • availability.

We reserve the right to:

  • correct any errors, inaccuracies, or omissions;

  • update or change information; or

  • cancel orders if any information is inaccurate at any time,

without prior notice (including after you have submitted your order). If we cancel an order, we will refund any amounts you have paid for that order.

for any reason, including if we reasonably believe that you have breached these Terms.

You remain responsible for any amounts owed up to and including the date of termination.

Sections that, by their nature, should continue after termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will remain in full force and effect.


SECTION 15 – DISCLAIMER OF WARRANTIES

The information and content on the Services is provided for general information purposes only.

Except where required by law, the Services and all products offered through the Services are provided “as is” and “as available”, without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of:

  • fitness for a particular purpose;

  • title;

  • durability; and

  • non-infringement.

We do not guarantee that:

  • the Services will be uninterrupted, timely, secure, or error-free; or

  • any content will be accurate, complete, or up to date.

You use the Services at your own risk.

To the extent that any disclaimer is not permitted under applicable law (including under Australian Consumer Law), that disclaimer will not apply to you and your statutory rights remain unaffected.

To the fullest extent permitted by law, The Folk Roaster Pty Ltd and its directors, officers, employees, partners, agents, contractors, and service providers will not be liable for any:

  • indirect, incidental, special, consequential, or punitive damages; or

  • any loss of profits, revenue, data, or replacement costs,

arising out of or relating to:

  • your use of the Services;

  • your purchase or use of any products; or

  • any errors, omissions, or other content on the Services,

even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim relating to the Services or any product purchased through the Services will not exceed the amount you paid for the product(s) in question.

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law, including under Australian Consumer Law.


SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Folk Roaster Pty Ltd, Shopify, and our respective affiliates, officers, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, claims, and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms or any related policies;

  • your violation of any law or third-party right; or

  • your use of the Services.

We will notify you of any claim for which we seek indemnification, and we may control the defence and settlement of such claim, provided that we will not agree to any settlement requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You agree to cooperate with us in the defence of any indemnified claim.


SECTION 18 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the unenforceable portion will be deemed severed from these Terms. This will not affect the validity or enforceability of the remaining provisions.


SECTION 19 – WAIVER & ENTIRE AGREEMENT

If we do not enforce any part of these Terms, that does not mean we waive our right to enforce it later.

These Terms, together with any policies posted on our site (including our Privacy Policy, Shipping Policy, and Refunds & Returns Policy), form the entire agreement between you and The Folk Roaster Pty Ltd regarding your use of the Services and supersede any prior agreements or communications.

Any ambiguity in these Terms will not be interpreted against the drafting party.


SECTION 20 – ASSIGNMENT

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment without consent is void.

We may assign or transfer our rights and obligations under these Terms at any time without notice.


SECTION 21 – GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them or the Services are governed by the laws of New South Wales, Australia, and the laws of the Commonwealth of Australia, without regard to conflict of law principles.

You and The Folk Roaster Pty Ltd agree to submit to the exclusive jurisdiction of the courts located in New South Wales, Australia.

Headings in these Terms are for convenience only and do not affect their interpretation.

You can review the most current version of these Terms at any time on this page.

We may update or change these Terms from time to time. If we make material changes, we will notify you in a way consistent with applicable law (for example, by email or by posting a notice on the site).

Your continued use of the Services after the changes take effect means you agree to the updated Terms.
